Terms of Service.

These Terms of Service (“Terms”) are a binding agreement between you and BlackMine LLC (“BlackMine,” “we,” “us,” or “our”) and govern your access to and use of blackmine.dev and any content, features, or services we make available through it (together, the “Site”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site. If you use the Site on behalf of a business or organization, you represent that you are authorized to accept these Terms on its behalf.

BlackMine is a Christ-centered digital marketing agency that helps small-business owners, ministry leaders, and faith-driven founders build marketing systems they own. Our guiding principle is straightforward: we build it, you own it, and we teach your team to run it. We aim to steward our clients’ work and data with honesty and care.

The Site is primarily an informational marketing website. It lets you learn about BlackMine, read our content, contact us, and schedule a call. Using the Site does not by itself create a client relationship. Any engagement for services is governed by a separate written agreement between you and BlackMine; if that agreement conflicts with these Terms, the separate agreement controls for that engagement.

The Site and its contents — including text, graphics, layouts, design, logos, and other materials — are owned by BlackMine or its licensors and are protected by copyright, trademark, and other laws. The BlackMine name, the four-quadrant purple cross logo, and our related brand elements are trademarks and brand assets of BlackMine LLC.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own personal or internal business purposes. You may not copy, reproduce, republish, distribute, modify, create derivative works from, or commercially exploit any part of the Site or our brand assets without our prior written permission, except as expressly permitted by these Terms or by applicable law.

When you use the Site, you agree not to:

• Use the Site for any unlawful, harmful, or fraudulent purpose.
• Interfere with or disrupt the Site, its servers, or networks, or attempt to gain unauthorized access to any part of them.
• Introduce viruses, malware, or other harmful code, or probe or scan for vulnerabilities.
• Scrape, harvest, or collect information about others without authorization, or use automated means in a way that burdens the Site.
• Infringe our intellectual property or that of any third party, or impersonate any person or entity.
• Submit false, misleading, or unlawful content through any form or contact method.

We may suspend or terminate your access to the Site at any time if you violate these Terms or misuse the Site.

If you submit information through the Site — for example, through a lead or “free audit” form — you represent that the information is accurate and that you have the right to provide it. We handle information you submit as described in our Privacy Policy. Any feedback or suggestions you send us may be used by BlackMine without restriction or obligation to you.

The Site may link to or rely on third-party services that we do not control — for example, Calendly for scheduling a call. When you use a third-party service, that provider’s own terms and privacy policy apply. We are not responsible for the content, practices, or availability of third-party sites or services, and linking to them does not imply our endorsement.

Content on the Site is provided for general informational purposes only. It is not professional, financial, legal, tax, or investment advice, and it should not be relied on as a substitute for advice from a qualified professional who knows your specific situation. Marketing results vary, and nothing on the Site is a guarantee of any particular outcome. You are responsible for your own decisions and for obtaining appropriate professional advice.

The Site is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, BlackMine disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any content is accurate, complete, or current.

To the fullest extent permitted by law, BlackMine and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.

To the extent any liability is not disclaimed, BlackMine’s total aggregate liability arising out of or relating to the Site will not exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you; in that case, our liability is limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless BlackMine and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time. When we do, we will revise the “Last updated” date above. Changes take effect when posted, and your continued use of the Site after that means you accept the updated Terms. If you do not agree to the changes, please stop using the Site.

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute that is not otherwise subject to an agreed alternative process will be the state or federal courts located in the State of Ohio, and you consent to the personal jurisdiction of those courts.

Before filing any formal claim, you agree to first contact us at info@blackmine.dev so we can try to resolve the matter informally and in good faith.

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any right or provision is not a waiver of it. These Terms, together with our Privacy Policy and any separate written agreement for services, are the entire agreement between you and BlackMine regarding the Site. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
